1. Scope

The following General Terms and Conditions (“GTC”) apply to all orders placed through our online store by consumers and business customers. Consumers are natural persons who purchase goods or services for purposes that are not primarily attributable to their trade or professional activity.

With respect to business customers: If the business customer uses terms and conditions that conflict with or supplement these GTC, their applicability is hereby rejected. They shall only become part of the contract if we have expressly agreed to them.

2. Contracting Parties, Conclusion of Contract, Correction Options

The purchase contract is concluded with konektra Vertriebs GmbH.

By placing products in the online store, we make a binding offer to conclude a contract for those products. You may place items in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the order process.

The contract is formed when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive another confirmation by e-mail.

3. Contract Language, Storage of Contract Text

The following language(s) are available for concluding the contract: German, English, French.

We store the contract text and send you the order data and our GTC in text form. You can view the contract text in our customer login area.

4. Subject Matter of the Contract

4.1 Product Description

The respective product description forms an essential part of the contract.

4.2 Product Images

Without prejudice to your statutory warranty rights, please note the following specifics. If in doubt, please contact us:

  • Due to individual display settings (e.g., resolution, brightness), slight deviations between on-screen and actual product colors are possible.
  • For wood products, natural variations in grain, structure, and color may occur.

5. Assembly

The provision of assembly services requires an express agreement.

5.1 Selection of Service Provider

We may perform the service ourselves or through qualified personnel selected by us. We expressly reserve the right to use third parties (subcontractors) acting on our behalf.

You are only entitled to insist on a specific individual to perform the service if and to the extent this is expressly stated in the applicable service description. Where third parties are engaged, we remain fully responsible for fulfillment of our contractual obligations.

Before engaging third parties, we will review them for reliability, appropriate professional training, experience, and/or ability to perform the contractually agreed services and bind them accordingly.

5.2 Access to the Assembly Site

The product will be delivered to the assembly site. You are obliged to grant the person(s) commissioned with the assembly access to the site.

6. Delivery Conditions

6.1 Delivery Area

We deliver within Switzerland.

6.2 Shipping Costs

Standard shipping within Switzerland is free of charge for orders of 500 CHF or more (incl. VAT).

6.3 Delivery Options

Products are shipped to the delivery address specified during the order process.

Delivery is by shipping only; self-collection of goods is unfortunately not possible.

7. Payment

7.1 Prices

The prices valid at the time of the order apply. All prices are total prices and include statutory VAT.

7.2 Payment Methods

The following payment methods are generally available in our shop:

Advance Payment (Bank Transfer)

If you select advance payment, we will provide our bank details in a separate e-mail and dispatch the goods after receipt of payment.

PayPal

To pay the invoice amount via the payment service provider PayPal (Europe) S. à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your login data, and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after you submit the order. Further information is provided during the order process.

PayPal may offer additional payment modalities to registered PayPal customers selected according to its own criteria. We have no influence over such options; any additional payment modalities concern your legal relationship with PayPal. Please see your PayPal account for further details.

8. Right of Withdrawal

Consumers are granted a voluntary right of withdrawal as described in the withdrawal instructions. Business customers are not granted a voluntary right of withdrawal.

9. Retention of Title

The product remains our property until paid in full. We are entitled to make the corresponding entry in the retention-of-title register.

Additional provisions for business customers: We retain title to the product until all claims arising from an ongoing business relationship have been fully settled. You may resell goods subject to retention of title in the ordinary course of business; all claims arising from such resale (regardless of combination or mixing with a new item) are hereby assigned to us in advance in the amount of the invoice value, and we accept this assignment.

You remain authorized to collect the receivables; however, we may also collect receivables ourselves if you do not meet your payment obligations.

We will release the securities to which we are entitled at your request to the extent that the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.

10. Data Backup

You are responsible for the proper and regular backup of your data. We are not liable for damage resulting from data loss insofar as the loss could have been avoided by regular and complete data backups by you.

The above limitation does not apply to claims for damages caused by us, our legal representatives, or vicarious agents in the following cases:

  • injury to life, body, or health,
  • intentional or grossly negligent breach of duty or fraud,
  • breach of material contractual obligations the fulfillment of which is essential for proper performance of the contract and on the observance of which the contracting party may regularly rely (cardinal obligations),
  • under a guarantee promise, if agreed, or
  • where the scope of application of the German Product Liability Act applies.

11. Warranty and Guarantees

11.1 Statutory Warranty Rights

Statutory warranty (liability for defects) law applies.

11.2 Guarantees and Customer Service

Information about any additional guarantees and their precise conditions can be found with the respective product and on dedicated information pages in the online store.

12. Liability

We shall be liable without limitation for claims based on damages caused by us, our legal representatives, or vicarious agents

  • in case of injury to life, body, or health,
  • in case of intentional or grossly negligent breach of duty,
  • in case of a guarantee undertaking, if agreed, or
  • to the extent the German Product Liability Act applies.

For breaches of material contractual obligations (cardinal obligations) caused by slight negligence by us, our legal representatives, or vicarious agents, liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded.

All further claims for damages are excluded.

14. Final Provisions

If you are a business customer, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a business customer, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us is our registered place of business.

Should individual provisions of these GTC be invalid in whole or in part, the remainder of the contract shall remain in effect. Where provisions are invalid, the content of the contract is governed by the statutory provisions.
